2025
It's been like what, 3 years since I've posted here;
I already have a degree in Law. The one I used to pray for and wish upon the stars - literally, sitting by my window;
I did fail on my 1st take during the 2024 bar exam;
Still unemployed. But I had some part-time and freelancing jobs along the way;
Life is still hard. But I'm in a better place now. I know my goals and the plans are getting clearer;
I only pray that I will already be a lawyer by 2025 when I come back here;
May this message be full of hope and wonder as I embark on my 2025 journey;
Lastly, I'm so proud of you, self. You have endured a lot but also overcome a lot and you will still rise above all the hurdles you have right now. I know it. May God bless me.

An Unexpected Present
Summary: Hope and reassurance comes from an unexpected source when Joel think there might be none.

A/N: Merry Christmas, pedroblr (is that a thing?) This is my little Christmas present to everyone and I hope (ba dum tss) it gives a bit of hope in terrible times in a different world. This is my present specifically to @docharleythegeekqueen as part of @pedrostories's Secret Santa event. Thank you so much for organizing this and I hope I have delivered as Santa.
People never turned up at your door at the crack of dawn. Thank goodness. It was mostly because you didn’t really have a door for the past two decades for anyone to show up at. Now you had one and apparently people—no, men— took that as an invitation to show up. Okay, it was one man. That was already one too many.
“What the fuck?” You asked, looking at the guy holding the most god awful bouquet of dried flowers you’d ever seen. Did they do Valentine’s in Jackson? And if so, did they do it in fucking December?
“You’re the chemistry teacher?”
Don’t fucking say some corny line about having chemistry with me, you thought, the old pick up line getting on your nerves before it could even be uttered.
“I am. And I won’t make you meth if that’s what you’re here to ask.”
He laughed softly, his cheeks turning pink from the winter air. “I wasn’t. But now I’m thinking about it. No, I’m uh… Ellie told me you knew how to make paint?”
You realized then that he was your student Ellie’s dad. Maria’s brother in law who used to be a contractor in the before times. His name had come up a few times when Maria’s husband told you about how they were fixing up the old houses in the town.
“Yeah…?”
“I was wonderin’ if you could make some for me. We can trade for it.”
“Oh. Uh, I’m sorry… I don’t make that kind of paint.”
“I didn’t even tell ya what kinda paint I’m lookin’ for.”
“For walls?”
“Wow. Why, cause I look like this,” he said, gesturing to himself, “I can’t be looking for watercolor to paint the next Mona Lisa?”
“The Mona Lisa was painted with oil paints.”
“It’ll be the watercolor Mona Lisa then. These flowers good enough to make some paint?” He asked, holding out the dried flowers and leaves.
“Depends on the colors you want for this post apocalyptic Mona Lisa.”
“Red, green, black and white.”
“Doesn’t sound like the Mona Lisa to me. Sounds like Christmas.”
“They told me you were smart, but not that you were a genius,” he mocked, making you roll your eyes. You would’ve closed the door on him and avoided him forever. It was a foolish way to spend the little resources you had on something like paint for Christmas decorations. Linseed oil for protecting wooden surfaces, alum for water clarification, and washing soda for…well, washing. So you told him as much. His face fell when you explained you won’t waste necessary resources for something as superfluous as paint. But he accepted, wished you a good day and left your doorsteps with his dried flowers.
You thought that would be the end of it. But you didn’t know a very crucial piece of information then.
“Why didn’t you tell me?” You asked, sounding more aggressive than you’d intended to be.
“Didn’t think it was relevant since ya said making paint is a waste of your time,” he said, sounding a little smug.
“That was before your brother said you had coffee! Why didn’t you tell me you had coffee?”
“You didn’t say what you’d trade for.”
“I’ll trade for coffee.”
Coffee it was. The next morning, he showed up at your door with a thermos full of coffee. Guilty about how you’d treated him the previous day, you invited him inside. What started as politeness became a routine.
“Had no idea it’d turn blue.”
“It’s because red cabbages have a chemical called anthocyanin. It’s a natural ph indicator. So when you add it to a neutral substance like water, it turns blue.”
He nodded, his annoyance at you beginning to change seeing the excitement on your face. It was easy to forget he was also resistant to normalcy when he first arrived at Jackson. Scarcity was the biggest threat to your life outside the infected and it wasn’t easy to set aside old practices you’d built to survive. But that didn’t stop him from being annoyed at you when you told him that paint for Christmas decorations was a waste of your time.
“Did you teach before, too?” He asked.
“No. I uh…I worked in the pharmaceutical industry. Made medicines.”
“Damn,” he said, his mind immediately going to Ellie. If she knew what you did for a living before… There was a real risk too, with you being her teacher and all. A bigger problem was you finding out somehow about Ellie’s immunity and deciding to do something about it. He could handle you of course. He’d handled fireflies with all their weapons. But it wouldn’t be easy to get away with in Jackson.
“Yeah. And before you ask, no I can’t find a cure.”
“Why did you think I’d ask that?” He squinted, his worries still not resolved.
“Everyone does.”
“Huh.”
The rest of the walk to the school passed in silence as he mulled over your words. You didn’t believe there was a cure so you wouldn’t look in Jackson for one. That should be enough to calm him. But you didn’t know someone in town was immune. He would have to keep an eye on you.

While the mornings were spend drinking coffee with each other, the evenings were for making paint. He’d gathered everything you needed. Even sat with you and helped you grind the ingredients with a pestle and mortar. You liked to spend your time alone after hours of dealing with loud, curious children.
You didn’t think you would be alright with Joel intruding on that. But he was good company. He stayed silent apart from asking doubts about the process. The only sound was that of the both of you grinding the pigment source into a fine power set with cyclical movements of the pestles in the mortars.
“You’re a big fan of Christmas?” You asked one evening.
“I wouldn’t say so, no.”
“So, why are you parting with your beloved coffee just for red and green paints?”
He laughed softly as he tied a filter to the top of a bottle. “It’s for Ellie,” he said, his hand rubbing the broken watch on his wrist. “She never had a normal Christmas so…since we came here to Jackson, I try to do what the town needs for a nice Christmas.”
“That’s nice,” you said, feeling yourself warming up to him. “How many Christmases have you had here?” You asked, not feeling it appropriate to ask when they arrived. Too personal and invasive perhaps.
“This is the second one.”
“Mmm. She deserves it. Ellie. She’s a good kid.”
“She is, yeah.”
“It’s…hopeful. Being around young people again. We are all so… Well, I am so disillusioned with the world. She seems to have hope.”
“Oh?”
“Yeah. Asked me if I could find a cure if there was someone immune.”
His heart almost stopped. What else did she tell you?
“And what did you say?”
“The truth. That it’s not possible even if we found someone with immunity.”
“Why is that?”
“We didn’t have the technology for this even back in the day. Not for fungi. It took years to create a cure even when we had proper labs and researchers. It’s not likely for us to even find someone who is immune. Even if I did, how would I get to the source of their immunity? We can’t do any tests. We can’t do imaging. If there was someone immune, they should just shut up about it and be alive.”
“Isn’t that selfish? Ruining the world’s chance to… to become…become normal?”
“It won’t. Not in our lifetimes. Say we do find a cure. How do we manufacture this drug or vaccine? How many can we make? A hundred? A thousand? And how would we even distribute it? I don’t think a few bicycles and our horses could be as effective as planes and ships to take them around the country. And these things have an expiration date, so…”
“I never thought of that.”
“Yeah. People are so intoxicated by hope that they fail to consider the logistics. I don’t blame them, though. It’s only natural to hope. Because if there’s no hope for the future, there’s no reason to do fucking anything.”
“Do you have hope?”
“Of course,” you said, giving him a smile. Not a naive one free of the burden of truth but a radical one persevering despite it all. “Jackson gives me hope. I didn’t think there could be such a place… There has to be an end to the fungus’ reign at some point in the future. When it has no one to consume. There could be people who are immune and natural selection could take its course, pass the immunity on genetically. Won’t be anytime soon of course. Maybe a few thousand years.”
“If humanity survives until then. We could all die like the dinosaurs.”
“We could. Or we could survive. If we’re here, who’s to say there aren’t other little towns persevering? Maybe a few will evolve and survive. They may no longer be us— homosapiens. But they’ll be here. But if not, there’s still all the animals who will look up at the same stars we see every night.”
“That’s strangely hopeful,” he said after a moment of silence. He wanted to cross the table between the two of you and give you a hug. Tell you that you were the only one who said something optimistic to him that wasn’t a load of rubbish.
But he went instead for an ornament just for you. Carved it out of wood how he did with all the other ornaments he made for the town’s large Christmas tree.
When you found the wooden star painted white at your door, you were surprised but had no doubt who it was from. You would never know what you’d done for him. He never doubted he made the right decision getting Ellie out of that hospital. But it helped hearing from someone who didn’t know what happened that she would’ve died for nothing had he made the wrong decision. It was an unexpected present. One you never intended.
And the next time he was at your door with flowers, they weren’t for making paint.

What I think the demigods would major as and why
these are personal head canons dont take them too seriously :)
Percy: Education. I know that we usually hc as a Marin biology kinda guy but I genuinely think that he wouldn't be too fond of the workload but instead want to work towards being a teacher and being the kind of teacher he needed as a kid, y'know? Alternatively, I can see him being into something like baking and pastry art to take over Sally's shop.
Annabeth: Architecture. I really don't think I need to explain this one to y'all but yeah she's an architecture girly. But if we want to branch out I can also see her studying law and working in the area of Child Protection.
Leo: Astrophysics. I have this head canon of him panicking because of the sheer amount of choices that he's presented with and choosing the first one of the alphabetical list. Lucky for him, he's insanely good at it AND it'll pay well in the future. He minors in mechanical engineering and realises that although he has all the practical knowledge because of his father, his theoretical knowledge isn't as strong lol.
Piper: Food Science. I'm trying to be unique here because yeah, she could do environmental studies but I also think it would be super cool to see her learning about food and developing new vegetarian versions of food because it's something she's visibly passionate about in the books.
Nico: I can see him getting a history / philosophy related degree for his bachelors just for him to get a doctor of philosophy (Ph. D.) in mythology or folklore. His hyperfixation runs deep and he sure as hell is going to fuel it as much as he can.
Jason: Doesn't go to college!! Is severely burnt out <3. No but like idk man I think he'd legitimately want to take it chill if that makes sense? Maybe he'd do a business major just so that he can get a job somewhere but I can't think of somewhere he'd fit in nicely. Jason does have a lot of part time jobs though!!
Frank: Nurse! Nursing school! Despite being the son of Mars I can see him being in the medical field because he wants to help people in need. It's a long journey with lots of ups and downs but finally getting his degree makes it all worth it.
Hazel: Geology because rocks. And also women in STEM!! This one directly correlates to her powers in the books as well as both of her parents! On the other hand, I can see definitely see Hazel studying in the field of archeology with the goal of being an archeologist and then eventually a museum curator :)
Reyna: Psychology!! Listen, I know this seems out of the blue but Reyna gives me the right vibes. Everyone is skeptical at first because they don't think she'd fit the mold of a clinical psychologist but that's okay because Reyna wants to further herself in research! She studies Neuropsychology and becomes a prominent researcher in her field! Please tell me you see the vision.
Will: From what I can see in the books, Emergency Medical Services degree seems like the right field for him. He's already basically a paramedic at Camp Half Blood so he knows it's naturally the right step for him. On the other hand, for something a little different - he seems like the kind of guy who might be interested in studying cinematography or art history maybe.
Travis: He studies Economics because he's so fucking convinced that he can become the next Elon Musk if he studies this. Alternatively, he studies music because he wants to travel the world and like sing with the wind and all that shit.
Connor: he's a communications major because he's a really popular youtube and technically doesn't really need to go to college but oh well he can study communications.
Drew: She goes to cosmetology school as the first step to start her own makeup and skincare empire. She's super nice to all of her clients and helps out all of the other students when they're having trouble with something! I will not tolerate any Drew slander let my girl breathe.
Pollux: Chemical Engineering. He got influenced by watching breaking bad and somehow landed himself a degree in chemical engineering. He doesn't know how he survived that degree but it doesn't matter because he decides to not give a fuck and open a coffee shop that becomes really popular because all the drinks are to die for.
Thalia: I don't really know the right terminology but she has an art related degree / tattoo apprentice so that she can work as a tattoo artist!! It fits with the thalis vision and also she is the eldest daughter who loses it lowkey so she doesn't follow your usual education route. Tattoo artist Thalia for the win!!

Post Human Studies: The Unreal State
This week, students, we return to the concept of Post Human Polities - PHP - as opposed to Post Human Species - PHS - as established in our previous lecture on the Progress Cult. As loathe as I am to bring up the maniacs behind the Progress Cult, if you can all forgive my editorializing, today's lecture deals with one of their successor PHPs, the Unreal State. The Unreal State most likely has deep ties to the social thought behind the Progress Cult which was Anarchoacademic Liberism.
For reasons you will come to understand, I hope, most of today's statements regarding the Unreal State must be coached in uncertainties. First however, let us discuss and attempt if not to define than circle a definition for Anarchoacademic Liberism. Anarchoacademic Liberism is an attempt at a revival of old Earthen ideologies of futurism and anarchism as understood by the Provost Major of the Progress Cult. To his understanding, anarchism was simply abolishing any and all social taboos and understandings as well as abolition of most state functions and futurism was putting ultimate faith in any and all new emergent technologies regardless of ethics behind them. As a student of Earthen and Human philosophies and ideologies, I must question where the Provost Major gained his understanding. The Provost Major thusly structured what remained of the Progress Cults state apparatus after various academic institutions supposing they would be best at encouraging the acquisition of information.
After the Applied Military Theories and the dissolution of the Progress Cult's holdings following the Provost Major's death, one of the break away polities was the Unreal State. The Unreal State was like many other successors to the Progress Cult, charismatic leaders putting their own spin on Anarchoacademic Liberism. However, the Unreal State took it one step forward, and began an assault against the very fundamental laws of reality.
This is now where things will have to enter supposition. Everything after this is conjecture. There are three possibilities to what the current Unreal State is.
The first is this, there is a pocket of space in what was once a Progress Cult controlled system once was. The Unreal State as much as it exists exists there, in space that no longer follows the same rules, if any, as the rest of reality if the space follows any rules at all. The Unreal State has managed to create a rupture in reality that in a system whose name can no longer be recorded on any form of media, believe me experts in the field of memetic hazardous storage have tried. Now that we have established that Unreal State now lies entirely within this rupture and potentially other ruptures comes the questions of those people who claim to be from the Unreal State. Those individuals we met claiming to be Citizens of the Land That Isn't and are displaying high levels of universal dissociation are from this Unreality and seek to spread its dissolution of reality with a fever that rivals adherents of the Green Orthodox Bible. Attempts to enter these gaping holes in reality, which now include what once was Mercury of the Sol System, more or less than resounding failures with to this dates no contact being able to be established or return trips emerging.
The second is this there is a pocket of space in what was once a Progress Cult controlled system once was. The second possible explanation is that these ruptures in space time are actually more akin wormholes, portals to a place we do not yet understand where only those who have spent long periods exposed to the Unreal State can survive, or those become citizens there. We have heard reports from surviving Citizens that have return that the state is engaged now and not just the war against the very fabric of reality but against those that maintain it and those beyond the veil. They claim knowledge of Cthulhiods, named after the Old Earthen Occultist’s Erotic Creation’s writing, and other creatures of the firmament such as Angels of Vangel. These citizens that they alone of humanity take the war for liberation to new fronts, they fulfill the work in words promised by humanity for years before. Whoever is part of this work they have emerged to changed, part of the universal disassociation is that in parlance some of you might laugh at they seem to clip through objects that were steady as possible they no longer react in the right ways on a physiochemical level to external interactions. Most worrisome part of this is that this does not seem to be isolated and is capable of spreading it is how Mercury once a famed center of medical research was dissolved and in the place where it once rotated now is a gaping Mall visible through the solar system at all times. It has made Earth's first colony Venus, turn itself into a fortificated world and reinforce the paranoia in isolation of the Martian gardeners. That of the four cradle worlds of mankind, on has been lost already, is a portent of doom.
The third is this there is a pocket of space in what was once a Progress Cult controlled system once was. This one is the most comforting one to me, all individuals claiming to be from the Unreal State are charlatans and delusional. The Unreal State does not in any form exist and it is merely a galactic Boogeyman. That all previous suppositions can be simply explained away through a clever trick of the hand and a heavy heavy dose of ignorance. This however is the least likely.
The one confirmed fragment I have found consistent is this.
"In the Unreal State, the whole of the law is this: There shall be no Law, neither against murder nor that yoke of gravity, and to oppose all other laws shall be your duty."
Even speaking of the Unreal State is fraught with the fact almost nothing is confirmed there are many suppositions many ideas of things that could be known but in the end what is confirmed is a little more than dust in the wind. I hope against hope to whatever deities that there truly are if they are benevolent in this world, that the Unreal State is simply a fiction of already unstable cultists. For the consider anymore of what it's potential truths imply makes me jealous of those with cybernetic implants who may cleanse their mind.

Ps: there's a lot of acronyms here to shorten some words. I don't know like there's a lot of shorten words😭 most of filo use it in everyday living or in messages.
so Robin going in UP taking ba in film/multimedia arts, or ba in social science. While Nancy going to UST taking ba in journalism/mass communications, or bs in forensic.
ba is bachelor of arts and bs is bachelor of science.
UP(University of the Philippines) is the top university in ph. Good for does who want to be in law program, it is a state/public university without tuition fee. You only pay with your brain. (joke, cause it's hard to enter here if you are not seriously academic inclined person.) Automatically, if you passed the upcat entrance exam congrats you are now 'iskolar ng bayan'. (scholars of the people, it's a deserving students dream to become one of it.) yay! but it's more way hard to get out:D this university doesn't have dress code/uniforms. You can wear whatever you want, or color your hair, you have a free will to be yourself.
UST (University of Santo Thomas) in the other hand, is opposite of the previous one. It's prestigious historical university, were national hero graduated here. It's good for future architect students. It's a private university, so there's uhmm tuition fee the entrance exam is no joke too(let's say, all top university in ph, entrance exam are no joke) it have a uniform uh for girls, I know it's ummm skirt mid way length and blouse.

I’ve not blogged about this yet, but I wanted to share the way I broke down names for my current longfic Aptronym, a fic focused on Klavier Gavin based on how simultaneously brilliant and stupid his name is.
The fic spawned from a taking notes on the different connotations of most of the Ace Attorney names in their localised form. It’s something that really stuck with me so I wrote about it.
So here is a character-by-character breakdown of their names that I have on-hand whenever I write. It’s not my full notes on the matter, but a streamlined version:
Klavier Gavin
Klavier - Piano in German, begins with K, matches initials with Kristoph. Phonetic smoothness, musician career, plays guitar. Aptronym
Gavin - G, Gavinners, Gavin brothers
Kristoph Gavin
Kristoph - Begins with K, matching initials. ‘ph’ ending, westernised spelling? Link potentially with lack of random German.
Gavin - Legacy, Gavin law offices and Gavinners
Apollo Justice
Apollo - Greek and Roman God. God of Music, healing, light and the sun (and more) sun and moon metaphors. Apollo programme, link to space.
Justice - Lawyer, Aptronym, turning on Kristoph.
Phoenix Wright
Phoenix - Mythical bird, rising from the ashes, rebirth, fire. Fire connoting light.

My coworkers are constantly making me feel insane for wanting to follow every safety protocol to the letter, with an abundance of caution. Some of this is them being stupid and some of it is probably me having a stick up my ass, but I will not apologize for it.
Because I have an anxiety disorder, I cannot accurately assess risks, and relying on the rules is how I stay safe in the absence of useful instincts.
Me: *disposes of haz waste in the haz waste bin, then rinses the container three times with distilled water and dumps that in the haz waste bin too. Just to be safe.*
Coworker (new undergrad on a different project than mine): *dumps haz waste in the haz waste bin but does not adequately clean glassware afterwards before putting it with the normal dirty dishes*

au is set in 2016. this is very vital to the story
lena's an international student to dlsu manila for a term (i was thinking business rich kid [so dlsu] and not lawyer/politician rich kid [admu]) bc when lillian suggested she join an international exchange program lena decided to choose the country the farthest away from lillian's influence (luthor corp has no hold in most of SEA [minus singapore obvs] and lena chose the philippines mostly because of the slightly less difficult language barrier) and majors in both science and business courses
kara got into up diliman through blood, sweat, and tears. her parents were researchers during the marcos era who were killed during martial law. kara was adopted by the danvers as jeremiah was the zor-els' co-worker and eliza was a traveling doctor. the danvers took kara and alex back to the states (usa) but kara wanted to figure out how and why her parents died and the ph is a great place to get a journalism degree so she studied up on not only the language but ph culture, history, and news as well before transferring to the ph the summer before her third year of high school. alex got a job as a medical consultant in the ph soon after and the two live together in qc (quezon city)
kara and lena meet when lena accidentally finds herself in the middle of a protest march passing through taft (kara started in up manila, not diliman hahaha)
she has no fucking idea what it's about
kara assumes lena's part of the protest and asks if she'd like to borrow one of her signs but then lena's like "what the fuck is happening"
"we're protesting marcos's burial in, uh, the national cemetery for heroes," kara explains and lena still looks so lost and kara feels both bad for the woman and awestruck that someone so beautiful exists. "marcos, like, ferdinand marcos? the country's ex-president that declared martial law, plundered the country in horrible debt, and then was banned from returning?"
lena knows some of those words, she thinks. she'd studied up on philippine history a little bit before she arrived but the textbook she'd read felt incredibly racist if not colonialist, but she's sure she read about a president declaring martial law before, so she nods as if she gets it
the protest keeps marching forward and lena finds that she can't really escape the crowd unless she wants to get crushed, so she sticks closest to kara who's both a friendly (gorgeous) face and also has the closest accent to hers
kara shares with lena more details about why they're marching and helps translate some of the more unfamiliar words of their chants
almost twenty minutes after lena accidentally joined the march, practically drenched in sweat but too moon eyed towards the blonde to care, lena finally asks where they're marching to

when kara sees lena's face fall, she gently takes lena's wrist and manages to maneuver them to the side of the protest, away from the wave of people. kara asks what's wrong and lena admits that she's already super fucking tired and would never be able to finish the march
kara understands and decides to accompany lena while they wait for a grab ride to arrive. as lena orders her ride, kara texts her activist and journalism friends to let them know that she won't be at the final rally anymore
while they wait, they learn more about each other and find themselves even more smitten than when they first met (sometime during this part, kara also gives lena one of her extra shirts [because she's a seasoned commuting pro and knows to never leave home without an extra shirt and small towel] so lena's just looking super comfy and cute in kara's shirt)
when lena's ride arrives, kara double checks the grab because she's That Kind of person before helping her in
"thanks for waiting with me. it was nice meeting you," lena says and kara smiles, wide and toothy.
"it was nice meeting you, too. ingat!" and kara closes the card door before she remembers to even ask for lena’s number
still, the lack of contact details doesn't deter her. she knows enough about lena that hopefully dropping by dlsu more often would mean being able to see her again

anyways if this was a short fic I'd def end it around here with kara and lena getting that date but if it were a long fic then i'd 100% make kara investigate and study the ejks (extra judicial killings) during duterte's time and lena learning and falling in love with the ph the way kara has which includes lena learning how to commute (which someday, when she leads l-corp, means that she helps build and fund a better fucking public transport system)

Aiming to put an end to the potential of people in poverty entering the sadly ever dwindling middle class caused directly by none other than Republican Party legislations of the past 5+ decades as well as put an end to the potential of increasing the numbers of educated & discerning voters whom refuse to vote for corrupt Republican Party politicians.

Grad PLUS loans for students seeking affordable funding for Masters, Ph. D., and Medical degrees will soon be entirely eliminated from existence, if Republican politicians have their way this January 2025. Literally used by middle/lower class American students TO AVOID 'PREDATORY LENDERS' LIKE PROPRIETARY MONOPOLIED CORPORATION BANKS--THE SAME BANKS that get bailed-out in the $BILLIONS$ with semi-regularity via middle/lower class tax-dollars, I might add.
Also, the elimination of 20-25 year student loan hardship forgiveness will accompany the earlier cuts, adding this to the Republican Party's older legislation chopping block which eliminated a student's civil right to apply for bankrupcy, specifically regarding government funded student loans.

"A key Republican lawmaker suggested this week that GOP priorities on student loans and higher education, including a repeal of time-based student loan forgiveness under income-driven repayment plans, could be included in an upcoming reconciliation bill early next year.
With Republicans set to control the White House and both chambers of Congress in January (albeit with narrow majorities), top lawmakers are preparing to use the budget reconciliation process to bypass the Senate filibuster, which typically requires 60 votes for legislation to advance. Republicans will hold 53 seats in in the Senate next year. By using reconciliation, Republicans would need only a simply majority to pass budget-related legislation. Top GOP lawmakers have suggested that at a minimum, the first reconciliation bill would include an extension of tax cuts associated with the 2017 Tax Cuts and Jobs Act, which was passed through the same process during the first Trump administration. But a top Republican this week indicated that student loan forgiveness reform could be included, as well.
'I still have hope that we'll be able to pass it in this session of Congress,' said Education and the Workforce Committee Chairwoman Virginia Foxx (R-NC) on Fox Business on Wednesday. But if it doesn’t pass this session, the bill 'could go into the reconciliation and be a part of the tax cuts extension,' she said.
Proposal Would End Time-Based Student Loan Forgiveness And Current IDR Plans For New Borrowers
Foxx’s bill, the College Cost Reduction Act, would eliminate current income-driven repayment, or IDR plans, for new borrowers. IDR plans use a formula applied to a borrower’s income and family size. Under current law, any remaining balance would qualify for student loan forgiveness after 20 or 25 years in repayment under these plans. IDR plans include Income-Contingent Repayment, Income-Based Repayment, Pay As You Earn, and Revised Pay As You Earn, which subsequently became the SAVE plan.
Under the College Cost Reduction Act, federal student loan repayment options would be narrowed down to just two: a Standard plan, and a new IDR plan called the 'Repayment Assistance Plan.' This new plan would be based on income just like existing IDR plans, and would use a formula similar to the PAYE and REPAYE plans. However, it would eliminate student loan forgiveness after 20 or 25 years in repayment. Instead, borrowers would only qualify for loan forgiveness once they have repaid 'the total amount of principal and interest that the borrower would have repaid under a standard repayment plan.' Some lower-income borrowers or those with high balances may never pay that amount, which could lead to some people being trapped in debt for their entire lives.
Under the current version of the bill, the changes would apply to 'All loans made… on or after July 1, 2024.' This suggests that borrowers already in repayment would be able to maintain access to existing IDR plans.
Student Loan Forgiveness Through Existing IDR Plans Under Separate Threat
Even if current borrowers could continue accessing existing IDR plans, significant threats loom.
The 8th Circuit Court of Appeals, which is handling a legal challenge over President Biden’s SAVE plan, blocked the Education Department from implementing the SAVE plan in August, forcing millions of borrowers into a forbearance. The court appears ready to strike down the SAVE plan entirely.
Depending on the scope of the 8th Circuit’s ruling, the ICR and PAYE plans could also be impacted, as these plans were created using the same regulatory process as the SAVE plan. Even though decades of regulations and bipartisan Education Department guidance reflected that these plans would result in loan forgiveness after 20 or 25 years, there is a distinct possibility that the appeals court could disallow loan forgiveness under these plans. The IBR plan, which was separately created by Congress, is not at risk from this legal challenge.
While the Trump administration has not expressly indicated what it intends to do with respect to IDR loan forgiveness, the administration could simply wait for the 8th Circuit to rule, and then not appeal that ruling (which the Biden administration had been expected to do). This would effectively allow the 8th Circuit to be the final word on IDR loan forgiveness.
Other Elements Of Proposal Would Impact Origination And Other Student Loan Forgiveness Programs The elimination of time-based IDR student loan forgiveness is not the only item in the GOP-sponsored College Cost Reduction Act. Other provisions, which some borrower advocates would support, include:
The elimination of the Parent PLUS and Graduate PLUS loan programs. Some advocates support this move, as these loans tend to have higher interest rates and can leave parents and older borrowers stuck in significant debt. However, other advocates are concerned that eliminating these programs would force borrowers to rely on riskier private student loans that don’t qualify for IDR or loan forgiveness and typically have inflexible repayment terms.
